These Terms of Service ("Terms") govern your use of plyamed.com/a/sass, demo booking, and related communications from Plyamed LLC ("Plya Med," "we," "us") about the Plya Med White Label Platform (the "Services"). By using the Services you agree to these Terms. If you use them on behalf of a company, you confirm you are authorized to accept these Terms for it.
1. The website and demos
This website describes the Plya Med White Label Platform and lets you book a demo. Demos, proposals and pricing shown here are informational. A subscription begins only when your company signs an order form or customer agreement with us, and that agreement controls if it conflicts with these Terms.
2. Pricing
Prices shown on this website (including the monthly platform license, per-seat pricing and one-time setup fee) are in U.S. dollars, exclude applicable taxes, and may change. Savings figures are estimates based on typical list prices for separate software tools and are not a guarantee of results for your business. Your order form states your final price.
3. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or to send spam or unsolicited messages.
- Attempt to gain unauthorized access to our systems, or interfere with their operation or security.
- Copy, scrape, reverse engineer or resell any part of the Services except as allowed by a signed agreement.
- Submit false information or impersonate any person or business.
4. Intellectual property
The Services, including the website, software, designs, text and graphics, are owned by Plya Med or its licensors and are protected by law. Screens shown on this website are illustrations with sample data. Customer names, logos and data you provide remain yours.
5. SMS / text messaging terms
Program: Plya Med White Label Platform demo and account notifications.
What you'll receive: when you provide your mobile number and agree to receive text messages from us, or text us first, Plyamed LLC may send you text messages about your demo and account, such as booking confirmations, reminders, rescheduling notices and follow-up from our team. Consent is not a condition of purchase.
- Message frequency varies, typically up to 5 messages per booked demo.
- Message and data rates may apply. Check your mobile plan for details.
- To opt out, reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT) at any time. You will receive one confirmation message and no further texts unless you opt in again.
- For help, reply HELP or email support@plyamed.com.
- Carriers are not liable for delayed or undelivered messages.
- You must be the account holder or have the account holder's permission to use the mobile number you provide. If you change or give up your number, reply STOP first or tell us.
We do not share your mobile number or SMS opt-in data with third parties or affiliates for their marketing. See our Privacy Policy for how we handle your information.
6. Third-party services
The Services may link to or integrate with third-party websites and tools, such as scheduling, accounting, payment and messaging providers. We are not responsible for third-party services, and your use of them is governed by their terms.
7. Disclaimers
The website and demo materials are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the website will be uninterrupted or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Plya Med will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the website or demo materials. Our total liability for any claim under these Terms will not exceed one hundred U.S. dollars ($100). Liability under a signed customer agreement is governed by that agreement.
9. Indemnification
You agree to defend and indemnify Plya Med against claims arising from your violation of these Terms or misuse of the Services.
10. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
11. Changes
We may update these Terms from time to time by posting a new version on this page with a new effective date. Continued use of the Services after an update means you accept the updated Terms.
